Terms and Conditions of Service

Version 1.0 — 2025

International Cargo Agency — Canada → Cuba | Canada → Latin America

1. GENERAL PROVISIONS

This document establishes the Terms and Conditions governing the cargo and shipping services offered by Easy Cargo Martel Express (hereinafter, "THE AGENCY"), with cargo transport operations from Canada to Cuba as the main route, as well as to other countries in Latin America.

By contracting the services of THE AGENCY, the CLIENT expressly and unreservedly accepts all the conditions described herein. These terms constitute a legally binding agreement between the parties.

2. DEFINITIONS

  • AGENCY: Easy Cargo Martel Express, responsible for the management and coordination of the shipping service.
  • CLIENT: Natural or legal person who contracts shipping services from Canada.
  • RECIPIENT: Person designated by the CLIENT to receive the goods in the destination country.
  • SHIPMENT: Any package, box, bundle, or merchandise delivered by the CLIENT for transport.
  • TRACKING DOCUMENT (GUÍA): Document that certifies the transport contract and describes the contents of the shipment.

3. SERVICES OFFERED

Easy Cargo Martel Express offers international cargo services from Canada, with the main route to Cuba and service to other Latin American destinations, including:

  • Package collection at home or drop-off at our facilities (subject to availability).
  • Cargo consolidation and preparation for air or sea shipment.
  • Export documentation management from Canada.
  • Coordination with clearance agencies in the destination country.
  • Shipment tracking and ongoing communication with the CLIENT.
  • Preliminary advisory on customs regulations at destination.

4. SPECIAL PROVISIONS — SHIPMENTS TO CUBA

IMPORTANT: Shipments to Cuba are subject to special regulations from both Canadian and Cuban authorities. The CLIENT must read and understand this section before making any shipment.

4.1 Cuban customs regulations: Cuba applies strict controls over personal imports. THE AGENCY will provide guidance, but it is the CLIENT's exclusive responsibility to know and comply with the import limits established by the Customs General of the Republic of Cuba (ADUANA CUBA), which may change without prior notice.

4.2 Regulated items in Cuba: In addition to the general prohibited items, shipments to Cuba are subject to specific regulations on:

  • Electronics and communications equipment (require special declaration).
  • Medications (subject to quantity limits and presentation of a medical prescription).
  • Food (subject to food safety regulations and permitted quantities).
  • Clothing and footwear (subject to quantity limits per person).
  • Personal use items vs. items for commercial purposes.

4.3 Taxes and duties in Cuba: The RECIPIENT in Cuba may be subject to payment of import duties established by Cuban authorities. These costs are the exclusive responsibility of the RECIPIENT or the CLIENT as agreed, and THE AGENCY has no control over such amounts.

4.4 Delays due to regulations: THE AGENCY will not be responsible for delays caused by customs inspections, package retention, or any procedure applied by Cuban authorities during the import process.

5. AGENCY OBLIGATIONS

  • Shipment preparation: Proper sealing of packages and inclusion of required documentation to process the shipment safely.
  • Safe packaging: Offer or suggest to the CLIENT appropriate packaging according to the type of shipment and destination.
  • Shipping information: Provide the CLIENT with information on available shipping methods, rates, chargeable weight, and costs.
  • Additional information: Inform about payments to be made by the RECIPIENT at destination to clearance agencies and customs.
  • CLIENT support: Provide contact information for inquiries and shipment tracking.
  • Compensation: Compensate the CLIENT for losses or damages directly attributable to THE AGENCY, when the claim is properly submitted in accordance with these Terms.

6. CLIENT OBLIGATIONS

  • Accurate information: Provide precise descriptions of personal data, the RECIPIENT's data, and the contents of the shipment.
  • Regulatory compliance: Know and comply with customs regulations in the countries of origin and destination, including prohibited items and permitted quantities.
  • Protection and packaging: Ensure adequate packaging for each item, especially fragile articles.
  • Recipient availability: Ensure the RECIPIENT is available at the scheduled appointment for clearance at destination.
  • Correct documents: Present valid and up-to-date identification documents to avoid delays.
  • Payment of services: Accept and pay the service invoice, as well as any fines, fees, or taxes applied by customs authorities.
  • Claims at destination: Instruct the RECIPIENT to submit any claim for damage or breakage in writing to the clearance agency before leaving the delivery location.

7. DISCLAIMER OF LIABILITY

Easy Cargo Martel Express will NOT be liable in the following cases:

  • Inadequate or insufficient packaging for the type of content being transported.
  • Prohibited or restricted content under these Terms or applicable laws.
  • Damage due to fortuitous events or force majeure (accidents, natural disasters, disturbances, external theft, etc.).
  • Loss or damage caused by third parties outside the direct control of THE AGENCY.
  • Delivery delays that do not result in loss or damage to the contents.
  • Fragile items not packed with adequate protective materials.
  • Failures or delays caused by contracted airlines or distribution agencies at destination.
  • Retention, confiscation, or seizure of merchandise by customs authorities in any country.

8. CUSTOMS AND INSPECTION

The CLIENT acknowledges that packages may be opened and inspected by customs agents in the countries of origin and destination. In case of total or partial confiscation:

  • THE AGENCY is exempt from any liability regarding the shipment.
  • The CLIENT assumes any consequence arising from the shipment of illegal or irregular products, being solely responsible before the authorities.
  • THE AGENCY does not interact directly with customs. All customs management is the exclusive responsibility of the CLIENT and the RECIPIENT.

9. LIABILITY FOR DAMAGE OR LOSS

THE AGENCY will be responsible only for losses or damages occurring during transport when direct negligence of its personnel or contractors is proven. This liability is limited to:

9.1 Optional insurance: The CLIENT may purchase optional cargo insurance under the following conditions:

  • The insurance must be contracted and paid before the shipment is dispatched.
  • To validate the insurance, the CLIENT must present proof of insurance payment and a declaration of the content's value at the time of shipment.
  • The insurance covers total loss or verifiable physical damage during transport, up to a maximum of 500 CAD.
  • Insurance claims will not be accepted for undeclared, prohibited, or inadequately packaged items.
  • Without insurance, THE AGENCY's liability is limited to 20 CAD x kg, with a maximum of 200 CAD.

10. REVIEW AND CLAIMS

Once the package is delivered and signed by the RECIPIENT, the service will be considered correctly rendered and the package received in good condition.

All claims for damage or loss must be submitted in writing within the first 48 business hours after delivery, with photographs of the package and documentation of the contents. After this period, THE AGENCY will not accept liability.

11. PROHIBITED ITEMS

The shipment of the following items is strictly prohibited:

  • Illegal substances, narcotics, or psychotropics.
  • Firearms, ammunition, or explosives of any kind.
  • Cash, checks, or negotiable instruments.
  • Hazardous, flammable, toxic, or radioactive materials.
  • Items whose importation is prohibited in the destination country.
  • Any merchandise that violates Canadian export regulations or the import regulations of the receiving country.

12. RATES AND PAYMENTS

  • Rates will be calculated based on the actual weight or volumetric weight, whichever is greater.
  • Payment must be made in full before the shipment departs, unless a prior written agreement exists.
  • Customs costs, import taxes, and clearance fees at destination are the responsibility of the RECIPIENT or the CLIENT as agreed.
  • THE AGENCY reserves the right to adjust rates with prior notice.

13. AMENDMENTS AND GOVERNING LAW

Easy Cargo Martel Express reserves the right to modify these Terms at any time. Changes will take effect upon publication or notification to the CLIENT.

This agreement is governed by the laws applicable in the province of Québec, Canada. Any dispute will be submitted to the jurisdiction of the competent courts of Québec.
